You agree that all information and documentation made available or disclosed to you through the Assist Web Site is confidential and proprietary information (“Confidential Information”) of FPL and/or the customer (“Customer”) of FPL on whose behalf you are requesting said information.
The Confidential Information will only be used to assist the Customer in qualifying, obtaining, paying or servicing his/her electric bill as issued by FPL.
You shall use all commercially reasonable precautions and take all necessary steps to prevent unauthorized disclosure, publication and dissemination of the Confidential Information by any of your employees, agents or affiliates.
You further agree, except as provided herein, not to cause any unauthorized use of Confidential Information.
You acknowledge that the disclosure of any Confidential Information which, at law, contract or equity, ought to remain confidential, will give rise to irreparable injury to FPL and/or the Customer which cannot be adequately compensated in damages.
Pursuant to the Assist Agency Agreement, you agree to notify FPL in the event of an unauthorized disclosure of customer confidential information.
